DSLV to design new forwarding conditions without shippers associations

The German Freight Forwarding and Logistics Association (DSLV) and the shippers associations could not reach an agreement on a joint new version of the German general forwarders’ conditions (ADSp) so far. After more than two years of intense negotiations to modernise and adapt the ADSp to the current legal situation. Despite joint efforts the parties involved have not been able to find common ground.
German freight forwarding and logistics companies run their businesses regularly on the basis of ADSp. Previously, these general terms and conditions were jointly elaborated by the German Freight Forwarding and Logistics Association (DSLV), Federation of German Industry (BDI), Federation of German Wholesale and Foreign Trade (BGA), German Chamber of Industry and Commerce (DIHK) and the German Retail Association (HDE), recommended for use on a non-binding basis.
“We regret that it has no longer been possible to unite the different interests in a joint work,” commented Uwe Lukas (Dachser) DSLV negotiator and chairman of the Commission on Law and Insurance, DSLV. However, the end of the negotiations does not mean the end for the ADSp, emphasizes the DSLV. All freight forwarding companies may still use the latest ADSp as a basis for business.
“The negotiations initiated by DSLV have definitely confirmed the need to reform the ADSp,” said Wolfgang Rode (German Post / DHL Group), deputy chairman of DSLV Rights Commission. “After the failure of the negotiations with the shippers associations, DSLV will soon recommended updated terms and conditions to its member companies,” he adds.
