DSLV publishes 2016 German Freight Forwarders’ Standard Terms and Conditions (ADSp)

The German freight forwarding association Deutscher Speditions- und Logistikverband (DSLV) has published the 2016 German Freight Forwarders’ Standard Terms and Conditions (ADSp 2016) on 14 December. The forwarding association recommends the application of the new ADSp as of 1 January 2016 – excluding the shipping industry for the first time after 90 years.
Issuing the ADSp 2016, the association is publishing terms and conditions adapted to the current law, and taking into consideration recent jurisprudence as well as current developments in the forwarding business. Also the exit of associations of the shipping industry from the terms and conditions of the updated ADSp means a balancing of both market interests“, reads a press release. However, DSLV wants to keep open the opportunity of joint terms and conditions in the future.
The ADSp 2016 include articles for electronic communication and documentation for the first time. In addition, provisions have been added, which specify the legal norms to load business, demurrage and pallet exchange.
Although the associations of shippers no longer involved in the revision of the joint conditions, numerous interests of the clients were taken into account in the new terms and conditions. Thus, the liability clauses are clearly based on the legal principles and the basic responsibility was more than doubled with the increase of EUR 5/kg to 8.33 SZR/kg (approximately EUR 10.50/kg).
“Today, more than 90 per cent of all freight forwarding and logistics companies in Germany work on the basis of ADSp. The ADSp 2016 will retain their high market acceptance – both in freight forwarding and logistics companies as well as on client side, “Hubert Valder, deputy general manager at DSLV is convinced.
